Abstract

The article draws attention to the fact that since the introduction of the Administrative Procedural and Procedural Code of the Republic of Kazakhstan (hereinafter referred to as the APPC), a new impetus has been given to the relationship between state bodies and citizens, and the nature and essence of the challenge claim in the public legal sphere has been studied on the eve of such important transformations. The views of a number of administrative scientists on the concept of an administrative claim are also given.
The authors have considered a number of conditions for the validity and validity of a claim for challenge, that is, two stages of the course and consideration of a claim for challenge in court according to the scheme-algorithm. The first stage is the verification of the challenge claim before the start of the trial for validity, and the second stage is the trial, checking the validity of the challenge claim.
In general, the need to take into account factors that may be invalidated or unfounded for an administrative claim is disclosed as a set of circumstances leading to its return and termination of consideration in court.
