Abstract

The article reveals the role and importance of forensic examination in the implementation of the tasks of the criminal process of the Republic of Kazakhstan. The author of the article conducted a comparative analysis of the Criminal Procedure Code of the Republic of Kazakhstan in 1997 and 2014, which allowed to reveal the problems of legislative regulation of forensic examination and expert opinion, as well as the shortcomings of the legislative structure of some legal norms related to the legal status of an expert and a specialist. The revealed collisions allowed the author of the article to come to the conclusion about the expediency of expanding the powers of the expert during the production of forensic examinations, which will allow the correct application of the criminal law.
