This article discusses the unity and difference between legal mentality and legal thinking. In modern scientific literature, there is a tradition of considering the essence of mentality through thinking and the image of thought. The author proposes to consider their relationship as a relationship between essence and phenomenon. Their features are directly related to the culture prevailing in society, the political and social environment, and directly affect the direction of their development. Legal mentality and legal thinking are considered as one of the main tools for modernizing legal relations.
