THE RULE OF LAW AS A MECHANISM FORPROTECTING HUMAN RIGHTS

The scientific article is devoted to the issues of the rule of law, the history of its emergence as a concept and legal phenomenon. The rule of law is considered as a universal principle of ensuring human rights, which all States must adhere to. The legal nature, the content of the rule of law as a mechanism, legal phenomena, and a conceptual approach to modern human rights are analyzed. The role of the Basic Law of the state in ensuring the rule of law has been studied and defined. The analysis revealed that the mere formation of a perfect legislative system that enshrines fundamental human rights and freedoms and establishes an effective legislative procedure is not sufficient to build a democratic society. The principle of the rule of law is, in fact, the only effective tool and control-guarantee for ensuring human rights.
