This article, including specific examples, considers the issues of distinction between an administrative offense and a criminal misconduct. In addition, it discloses certain aspects of liability and penalties prescribed by law, which are in fact disproportionate to the severity of the offense and the personality of the offender. The stated circumstances prove the necessity to improve the mechanism of responsibility and punishment for criminal misconduct. The author concludes that in order to resolve these pressing issues, it is first necessary to determine the hierarchy of codes at the same level and to introduce changes and additions to the Criminal Code and the Code of Administrative Offenses.
