Abstract

The article highlights some issues of fixing fairness in civil proceedings.
Justice is seen as the starting point in the administration of justice. This is due to the
existence of general laws regarding events and trends in human history - laws based
on that part of morality, which are eternal. This is evidenced by acts of various kinds
throughout the development of society. The modern civil procedure legislation of the
Republic of Kazakhstan does not fully meet the provisions of our Constitution on the legal
and social state. The proclamation at the constitutional level of the rule of law and natural
human rights and freedoms logically leads to the appropriate incorporation of the concept
of natural law into the legal system as a whole, since it allows for the practical solution of
the issues of building a just society. On this basis, it is proposed to supplement the CPC
RK with relevant norms.
